PEC das drogas deve ser votada no plenário do Senado após a Páscoa

O presidente do Senado, Rodrigo Pacheco (PSD-MG), afirmou nesta terça-feira (26) que a PEC (proposta de emenda à Constituição) que criminaliza a posse e o porte de qualquer quantidade de droga ilícita deve ser votada no plenário após o feriado da Páscoa. O texto já foi aprovado pela Comissão de Constituição e Justiça da Casa, em um momento em que o Parlamento busca responder ao julgamento do STF (Supremo Tribunal Federal) sobre a descriminalização do porte de maconha para uso pessoal.

"Estamos contando o prazo de cinco sessões de discussão. Amanhã temos mais uma sessão de discussão da PEC 45, e, finalizado o prazo de cinco dias, aí fica apta a ser apreciada no plenário. Acredito que após o feriado da Semana Santa nós já tenhamos condições de apreciar em primeiro turno a proposta de emenda à Constituição", detalhou Pacheco. 

A PEC adiciona ao artigo 5º da Constituição o texto afirmando que "a lei considerará crime a posse e o porte, independentemente da quantidade, de entorpecentes e drogas afins sem autorização".

Pacheco é o autor do texto e tem defendido a aprovação da proposta, com consequências legais para quem porta drogas no Brasil. 

Como o texto altera a Constituição, ele precisa ser discutido em cinco sessões no Senado antes da primeira votação. Depois disso, serão mais três sessões de discussão antes da votação. em segundo turno. Para ser aprovada, ela precisa do apoio de pelo menos dois terços dos senadores em ambas as votações, o que equivale a 54 votos. Se aprovado, o texto será enviado à Câmara dos Deputados.
